The American Legion’s Texas department broke publicly with its own national leadership this month over the Take Care of America’s Veterans Act, a sprawling benefits bill better known by its acronym, TCAVA. Texas wants national headquarters to reverse course and oppose the bill outright. National headquarters, so far, isn’t budging.

What Actually Happened in Austin

The split became public right after the Texas department wrapped its 107th annual convention in Austin, held July 7 through July 12. Veteran advocate Elizabeth Hartman posted about it shortly after, describing Texas as having split from national and demanding the organization oppose TCAVA.

People online debated what “split” even meant here. Some read it as a full break. Others read it as Texas issuing a strongly worded objection, not leaving the organization. Either way, commentators called it close to unprecedented for a state department to publicly break ranks with Legion national headquarters like this.

National headquarters hasn’t backed down. National Commander Dan K. Wiley keeps calling TCAVA a $58 billion proposition, and he’s arguing Congress needs to pass it now, before the savings tied to VA disability rating changes get swallowed by the Treasury instead of funding veterans programs.

The One Provision Causing All the Trouble

TCAVA isn’t a single-issue bill. It bundles more than 60 proposals covering disability compensation, health care, education, caregiver support, survivor benefits, and transition programs. It also carries the Major Richard Star Act, which would expand concurrent retirement and disability pay for combat-injured veterans who retired short of 20 years of service. That piece has bipartisan support on its own.

The fight is over Section 108. That’s the part that would change how the VA rates future disability claims for tinnitus and sleep apnea. It wouldn’t touch benefits already awarded — anyone currently rated stays rated. But it would lower or eliminate what current service members and future veterans could claim for those conditions going forward.

A coalition of 15 veterans and military organizations ran the numbers and landed on roughly $57 billion in costs shifting onto as many as 1.5 million future claimants. Their argument isn’t that TCAVA’s other 59-plus provisions are bad. It’s that Congress shouldn’t pay for popular programs by quietly reducing what younger veterans and future retirees can claim.

Then the House Rules Committee closed off debate on it. Democratic amendments that would have stripped Section 108 or replaced its funding offset with something else never got a floor vote — the rule blocked them before they could.

National Leadership’s Case for the Tradeoff

Wiley doesn’t pretend this is a clean win. He’s said publicly that the Legion would rather future veterans not foot the bill for programs that help veterans today. His argument is about what’s realistic: the Major Richard Star Act and similar priorities have failed to pass on their own, year after year, without some kind of funding offset attached. TCAVA, in his view, is the version that actually has a shot at getting through Congress.

National leaders also point out that the VA could make the same tinnitus and sleep apnea rating changes through regulation, with or without this bill — except then the savings wouldn’t go toward veterans programs at all. Wiley says the money TCAVA frees up would fund suicide prevention, traumatic brain injury care, and caregiver assistance, among other programs.

Mission Roll Call, a separate veterans organization, has pushed Congress to move fast and pass the full package, citing broad support for TCAVA overall even amid the Section 108 backlash.

What This Doesn’t Change — Yet

Texas breaking ranks doesn’t force national headquarters to change its position. The American Legion nationally is still publicly campaigning for TCAVA’s passage. But the split makes an internal argument visible that’s usually kept behind closed doors: how much should today’s veterans’ wins cost tomorrow’s veterans?

That question isn’t going away quietly. If more state departments follow Texas’s lead, national leadership may have a harder time claiming a unified membership behind the bill — even if the numbers on paper still say Legion supports it.
