Rebel Creamery Files for Bankruptcy While Appealing $23.8M Judgment

A popular ice cream brand found in grocery stores nationwide just filed for bankruptcy. Rebel Creamery, the maker of Rebel low-carb ice cream, filed for Chapter 11 protection on August 14 in Utah, weeks after losing a massive trademark lawsuit to rival Van Leeuwen Ice Cream.

Here’s what happened, and what it means for a brand you’ve probably seen in your grocery store’s freezer aisle.

What Triggered the Bankruptcy?

A federal judge ordered Rebel to pay Van Leeuwen $23.785 million in a trademark dispute over ice cream packaging. Judge Eric Komitee ruled on July 16 that Rebel had intentionally copied Van Leeuwen’s distinctive packaging design.

The case dragged on for more than five years before reaching a final ruling. Komitee decided it after a bench trial, not a jury, and found Rebel liable under both the federal Lanham Act and New York law. He also rejected all of Rebel’s counterclaims.

The judgment wasn’t just financial. Beyond the $23.8 million payout, the order also bars Rebel from selling its current packaging and forces the company to redesign it entirely.

How Bad Is Rebel’s Financial Situation?

Rebel reported $13.78 million in assets against $23.85 million in liabilities. That gap comes almost entirely from the Van Leeuwen judgment itself, which accounts for nearly all the company’s listed unsecured debt.

The company still has some cash on hand: about $5.22 million in cash and equivalents, $2.59 million in accounts receivable, and $5.65 million in inventory.

Why File for Bankruptcy If the Case Is Being Appealed?

Rebel filed its notice of appeal just two days before the bankruptcy filing. So the two legal moves are running on separate tracks. The bankruptcy case deals with restructuring Rebel’s debts and keeping the business running. The appeal challenges whether the $23.8 million judgment should stand at all.

Because of the bankruptcy filing, Van Leeuwen’s claim now sits marked as “disputed” in Rebel’s court filings, since Rebel is actively contesting the underlying judgment. It’s still unclear how much Van Leeuwen will ultimately recover, or how the appeal might change that number.

Where Is Rebel Ice Cream Sold?

Rebel operates out of Midway, Utah, and its ice cream lines grocery store freezers at Walmart, Target, Kroger, and Safeway, among other major retailers.

What Happens Next?

Chapter 11 gives Rebel a chance to reorganize its finances while it keeps operating and fights the judgment in court. But that’s a tricky balancing act: the company now has to manage bankruptcy proceedings and an active appeal on one of the largest liabilities on its books, all at the same time.

For now, an automatic stay pauses all litigation against Rebel while the bankruptcy case moves forward.
